He's 88 years old and Joe Simon has been fighting for 58 years to revoke the 1940 transfer of copyright for Captain America to Marvel Comics.
Under U.S. law, the creator regains copyright of charakters created before 1978 , after 56 years.

The battle in the legal arena was supposed to be settled in 2001, but it still continues. Marvel seems to play dumb. They're probably waiting for Mr.Simon to die before he gets back what is legally his creative property.
